Pensioner claiming RP and Pension Credit top up for his wife. His wife is only in her 40’ sand recently started work so PC has ended and HB/CTB as she has claimed WTC. Are they entitled to HB/CTB “run on” at all as in theory she could have been claiming income based JSA for them both as a couple ?

Under the “pension age” HB/CTB regs, an extended payment is only allowable if it became payable under the “working age” regs.  There are no exceptions.  Based on the info given, HB/CTB was not in payment under the “working age” regs and, if that is correct, EP cannot be paid.

As the law currently stands, any further HB would still be assessable under the “pension age” regs.
