19 yr old lad left college in June for a gap year and tried to claim ib JSA (still lives at home). Mum gets CB until the terminal date 31 August (CTC ended in June under CTC rules).  His JSA claim refused because mum gets CB. Mum tried to close CB award thinking this would allow son to claim JSA, but told not possible or at least that closure still wouldn’t allow a JSA claim by son.  Therefore minimal income for/on behalf of son until after Aug terminal date when he can finally sign on (unless of course in meanwhile CB stops because he works 24hrs plus). Have checked Regs and this would seem to be correct ...but would be glad of confirmation form others as complicated trail. SSCBA s 141-2 person responsible for QYP shall be entitled to CB: CB Regs 2-8…youngster under 20 who has ceased FT relevant education is a QYP until the terminal date [for CB purposes]: JSA Act s1 person cant claim JSA if in relevant education: JSA Regs Reg 54 a YP is treated as in RE if QYP under SSCBA s 142 (ie QYP for CB).

Yes, it’s right. He’s a qualifying young person till his terminal date ‘cos he still counts as being in relevant education.

I’m surprised that the CTC stopped though - how do you mean, it stopped under the CTC rules?

I’d always assumed that an18 or 19 year old’s QYP status continued until the terminal date after the end of their course for both CB and CTC purposes.

Having had a quick look at the TC manual http://www.hmrc.gov.uk/manuals/tctmanual/TCTM02220.htm and the CTC regs http://www.opsi.gov.uk/si/si2002/uksi_20022007_en.pdf  It seems I’ve been wrong.

I can’t see any grounds for a challenge. I’d be really interesed if you find one

Yes, re CTC, I had checked out the CTC Regs and http://www.hmrc.gov.uk/manuals/ntcmanual/eligibility_ctc/ntc0270040.htm before I was able to agree as seemingly correct the end date for CTC, and before posting my message.. So we are still left with the problem of no JSA (or CTC) and only CB, up until end Aug, unless the young man can find a job. Seems tough.
