can you claim IS when you are sick /disabled -I think the answer is yes!
The client is 54 and has a private pension of £73.92 per week and DLA (care) low rate. She claimed ESA but was not entitled to income based as income above applicable amount of £67.50. She was refused contribution based due to lack of NI conts. Therefore can she claim an IS top up as the applicable amount for IS would be £67.50 plus £28.85 disability premium = £96.35

I think the answer is yes although she would be entitled to ESA once the work-related component was added!

Or indeed she could sign on now for JSA, and get paid more.
