If client is eligible for the carers element and has an underlying entitlement to LCW can they get the work allowance for earned income?
If client is eligible for the carers element and has an underlying entitlement to LCW can they get the work allowance for earned income?
Looked at various sources e.g. reg 22 UC regs which would seem to indicate yes. But can someone confirm yay or nay please.
Yes, definitely.
Remember, nowadays, most claimants don’t get the LCW element anyway…
Thanks Charles!!
Does anyone know if the UC build actually recognises these cases i.e. if claimant getting the CE, would the algorithm in the calculation kick in the LCW to ensure the Work Allowance / earnings disregard is applied?
Edited for typo.

‘it would be automatic
although not being paid lcw - they still have it
so when you go down the bottom of the statement there are some + symbols that show “if you think we have made a mistake” & “other support you may be able to get”
If they click the + symbol on the other support you may be able to get it says examples of support you can get
then it will say
what you can get may depend on how much you earn
your take home pay for this universal credit period is £xxxx - this is what they show for examples pharmacies for free prescriptions or dentists etc - but in that section it also will say “you have limited capability for work”
The whole thing will be automatic’.
