Rental of a garage

Client rents their home from social landlord and gets UC housing costs.

They also rent a garage from the same landlord but at a different address and under a separate tenancy agreement. The rental of the garage began before the residential tenancy did.

The client is not currently getting UC towards the garage and I don’t think they would qualify as they don’t occupy the property as their home and it is not residential.

However under the list of eligible service charges, tenant car or bike parking is listed. It says such charges must relate to maintaining a parking service for tenants and must not relate to the provision of security for the tenants vehicle.

Its not a service charge however, its the rental of the space.

Any thoughts?

I think you are referring to para F2072 in the ADM.  This is related to service charges in Category B: upkeep of communal areas.  If the garage is for the claimant’s use and not shared with other tenants, I don’t think it belongs to that category.
