set aside and/ot written statement of reaasons

wanting a set aside as Tribunal went ahead with a paper hearing even though an oral one was requested, does a written statement of reasons need to be requested BEFOER a set aside can be done ????? its a HB appeal

I don’t think so. Rule 37 applies and doesn’t require a statement of reasons:

Just make sure you explain clearly why you want a set-aside and why it would be in the interest of justice to do so.

You do not need a statement of reasons to request a set aside.

However it is usually a good idea to request a statement of reasons as an alternative in the event that the set aside is refused - as otherwise you may be out of time to request an SOR once the decision on the set aside comes back.
