Disabled students and UC pre December 2021

Hi there,

Currently have a client with tribunal coming up and just wondered if someone could confirm that i’m interpreting the law/regs correctly.

Client claimed UC in July 2021 (already gets PIP)

In August 2021, client contacts GP about WCA and gets fit note

September 2021 To do raised on claim for WCA

End of September 2021 client starts at university and claim closed as has not been through WCA process.

My thoughts are that there is no merit to the appeal as while they were receiving UC before starting university they still hadn’t had their WCA. A lot of the info out there concerns the change from December 2021 so just wanting to confirm my understanding.
