Hi

Have a customer who wanted a DHP over 2 assessment periods - 1 assessment period he didnt receive a payment as his (carried over) income tapers were too high - as a result we refused DHP for that period saying “a relevent award is one where you get a payment of UC”

He is saying as his UC claim continues an award of nil shouldn’t prevent him getting a DHP ( hes querying the wages used with DWP but thats a different ball game)

So - is there anything caselaw/guidance wise that states a relevant award means a payment of UC?

Or should I advise that he can seek advice about a JR and he may want to use that as the basis of his argument, (That we say a relevant award = a payment of at least 1p)
