PIP Overpayment and Potential Prosecution

Hi

Hoping for some advice on this -

We are helping a client who has been given a £32K overpayment of PIP/PIP Suspension due to potential fraud. The DWP believe he is actually able to do all descriptors.

He’s received a letter from the DWP stating that the matter has been referred to the CPS for prosecution should the CPS find there is enough evidence.

As a generalist/non-legal adviser, am I still able to help the client with the PIP overpayment appeal or should I be advising that my client seek help from a fully qualified solicitor in this matter?

I’ve never had a case which was so serious as to be fully referred to the CPS so its quite new to me.

You should advise your client to consult a criminal law solicitor, preferably one with experience of dealing with allegations of social security fraud, straightaway. Criminal proceedings and the overpayment appeal run in parallel and you should then liaise with the solicitor as to who does what on the appeal.
