Suspending HB whilst on passporting benefit

Hi

Can anyone remind me of the name of the case that discussed the ability of a local authority to go behind a DWP entitlement decision on a passporting benefit?
I’m assuming that decision related to decisions terminating the HB award rather than simply suspending it but I can’t remember.
Cl gets IRESA but HB suspended on capital grounds. Cl has accrued capital from unspent direct payments. I’m aware this issue came up not very long ago.
LA has informed ESA of it’s concerns but ESA still, to date, in payment.
Arguments about ownership of capital and disregarded direct payments aside, I’m just checking the position on suspending the HB whilst ESA in payment.
HB waiting for ESA to consider but HB has been suspended since January.
All thoughts appreciated.
