HB &UC; - ?protection

Working with a young man who has always lived with his mother.
Rented property together. She claimed Pension Credit and HB
He claims UC and receives a housing allowance.

Sadly, his mother has now died. He is receiving LHA (paid at one bedroom rate) only as part of his UC claim. DHP have made a payment for 13 weeks and advised that there should be ‘run on protection’ from HB.

Clearly, he can no longer afford the rent (actively looking for work now no longer a carer) and is at risk of homelessness.
Any advice or expertise?

The mother’s HB will end on the Sunday after the death. There is a bereavement run-on in UC but not sure it helps your client.

When certain people die (including disabled people you get the carers element for) it protects the amount of UC in payment for the current + next 2 assessment periods but if your client is only receiving the standard allowance + housing costs element; that’s what he would be entitled to anyway so there’s nothing to protect. If he is getting the carers element, this could be subject to the bereavement protection.

UC should treat him as liable for 100% of the rent as the joint tenant has passed but if he is already restricted to LHA cap, that won’t help either.

Sadly I can’t see much more than DHP + maximising income whether through work or benefits + seeking alternative accommodation, as options I’m afraid.
