Hello

Cl was on income-related ESA in the support group with SDP, PIP, and HB/CTR. He went into prison for six weeks (no details). He is now out and has made a claim for UC and has been asked for fit notes. PIP has been reinstated. HB was paid whilst he was in prison.
My understanding is that for ESA, you are treated as not having LCW even if you have been assessed as satisfying the WCA, if you are in prison and therefore disqualified from income-related ESA. I am guessing this means that he would not therefore qualify for credits for LCWRA meaning that he has to undergo a new WCA for UC?

Cl says he has been told he can make a rapid reclaim for ESA because he was in prison for less than 12 weeks. But in any event, the UC claim has already been made and a stop notice sent to HB.

Any thoughts welcome. Should his LCWRA to be carried over to UC?
