Hi

Can you work 12 hours and still claim LCW under UC?

My client has been turned down for LCW but no reason given. I know you could do some hours under ESA but can’t seemed to find a definitive answer on permitted work and still claim LCW. Client suffers with Autism and cannot work anymore hours without going into a meltdown.

I Don’t want to waste my clients time going down the appeal route if we aren’t going to win regardless.

You can work unlimited hours on LCW/RA, but the WCA can’t be carried out if you already earn 16xNMW (unless claiming PIP/DLA).  See UC reg 41.
