“moving in” for UC HCE purposes

Tenancy began about six months ago while tenant was in care home. First night in the property was last Friday. Tenant was previously street homeless and initially had no possessions. He bought a bed and had it delivered to the flat three months ago, and has gradually had other stuff delivered since then. He has been visiting the property regularly (mainly to receive deliveries).

For UC purposes, I want to argue that tenant “moved in” three months ago, and can then get an additional month backdate under Para 8 Sch 3. Does that sound viable?

A bit of clarification (as I was in a bit of a hurry when I posted my original question):

I’m hoping to rely on R(H)9/05. It seems that Commissioner Mark’s comments in that decision apply equally to the UC Regs and WRA (as to the HB Regs and SSCBA)- it seems to me to be very similar language. Does anybody know if there’s any UC-specific caselaw to contradict this please?
