I’ve a pensioner receiving the shared accommodation rate of LHA - his housing is not self contained

the landlord wants to put the rent up above shared acom LHA (for various reasons)

there are exemptions to the shared acom rate, even when you are in shared acom

the example I’m thinking is if he receives AA would he then qualify for the 1 bed LHA rate?

I’m having problems finding a way to get him the 1 bed LHA rate - any suggestions would be welcome

The only relevant exception would be if he is eligible for the SDP - i.e. if he is awarded AA, has no one living with him and doesn’t have a carer. If that applies, he will qualify for the one bed rate. Otherwise, it will be the shared accommodation rate. See reg 13D(2) HB (SPC) Regs.
