UC entitlement - FT student with partner who is a PSIC
Client is a FT student so the usual position is she wouldn’t be eligible for UC, But one of the exceptions is a “student with a partner who is not a student”. On a straightforward reading of this, she’d be able to claim as her partner isn’t a student but he is a PSIC. What do you think? Given that it is a joint claim then converted into a single claim, does the presence of him as a partner still allow her to get UC even though she’s a student? It seems illogical that having a partner who is a PSIC and not eligible himself would allow her to claim but I’d love your opinions. Many thanks in advance

Just noticed. You wouldn’t be asking the question if they had children! Silly me.
I don’t think they will qualify as partner is not a student who can get UC. Nor is partner entitled to UC on there own due to NRPF condition - Reg 3(2)(b) UC Regs.
