2 Homes payment when moving from UC to HB
Hello
If a person moves from private rented accommodation (rent covered by UC HCE) to sheltered accommodation (rent covered by HB), can they claim 2-Homes payment? - he has unavoidable liability because he has to give a month’s notice. He meets all of the HB conditions for a 2-Homes payment (e.g. he has physically moved into the new home)
I’m aware that this isn’t available to UC claimants - but might it be available in this scenario now that he has HB for the new home? Or, is it not possible because it was UC covering the old home?
Any thoughts?

Not if he is still on UC for living costs. Reg 5 of the UC (Transitional Provisions) Regs 2014 prevents dual entitlement to HB and UC except where the HB is in respect of specified accommodation so he wouldn’t be able to get HB for the general needs tenancy at the same time as UC

This is where I got confused.
His new home is exempt accommodation so his UC is ongoing, and the HB for the new home is a new claim. I’m not entirely clear on why this new HB claim can’t include a 2-homes request for the old home. Is is because the old home was covered by UC HCE?
It is because Reg 5 precludes entitlement to HB except where it is “in respect of” TA or SA. A payment towards the rent of the previous property would not be “in respect of” the SA.
