Judicial Review during COVID-19

New report from the Public Law Project looks at how the judicial review process in the Administrative Court has operated under COVID-19 measures:

Our initial findings suggest that there is support for the judicial review process continuing during the COVID-19 lockdown and that remote hearings have certain strengths. However, there are also various technical difficulties and remote hearings are not seen as universally appropriate, even in a heavily ‘law-focused’ jurisdiction such as judicial review ...

... we intend to collect further data on how the Administrative Court is operating during the pandemic. Further engagement with lay clients, legal representatives, Court staff, and judges is crucial ... The developing experience of the judicial review process in these unusual circumstances may, if properly studied, provide important insights about the future of the system, and digital justice more generally, after the pandemic.
