I had a client with a query which is that client is usually employed term time during the school year. When Client has to stay home due to the holidays especially the summer strech, is client eligible to claim Job Seeker’s Allowance.

Also if Client falls sick during the holidays is Client eligible for Statutory Sick Pay as Client is not paid during the holidays or does Client claim Employment and Support Allowance?

I would be grateful if anyone could assist.

For tax credit purposes term time only workers are treated as in full time work throughout the year but there appears to be a difference betwen those with a contract for a fixed period like one term and those with an indefinite contarct of employment (see p.1277 of the latest ‘Handbook’). There do not seem to be any special rules for term time workers as far as SSP goes so it may be that if they satisfy all the other condiotions for SSP they wil be eligible
