My client is currently appealing a UC right to reside decision. In the mean time she had a baby and as they were destitute they have been provided with accommodation and subsistence payments by Social Services, I believe under section 17 of the Children Act 1989.  If she wins her appeal will the regular subsistence payments be taken as income by UC in calculation amount payable for the period?

I don’t believe so. Unearned income which is taken into account when calculating UC can be found at reg 66:
