We have been advised that clients (under 60’s) who are permanent residents in Residential/Nursing Homes are to lose their disability premium after being in the homes for 52 weeks. The DWP have advised us that clients in Residential/Nursing Homes are to be treated the same as those in a hospital or similar institution.

Has anyone else any experience of this happening in their area?
Has anyone appealed this?

Any information welcome, thanks in advance.

Could the DWP be mixing up the rules for enhanced disability premium and disability premium?  Extract from DMG:

23183 DLA highest rate care component may continue to be payable when a person is admitted to a care home or independent hospital. In such a case EDP will continue to be payable until entitlement to the DLA highest rate care component ceases1or the person who satisfies the premium condition becomes a long term patient2. 1 IS (Gen) Regs, Sch 2, para 13A(1); JSA Regs, Sch 1, para 15A(1) & 20IA(1) 2 IS (Gen) Regs, Sch 2, para 13A(2); JSA Regs, Sch 1, para 15A(2) & 20IA(2)
