LA fail to signpost to UC - non compliant with guidance?

I have someone who’s missed out on 3-4 months of UC entitlement because her local authority failed to respond to her HB claim promptly.

She is now submitting a UC claim and requesting the 1 month backdate.

I am looking into raising a complaint to the LA and requesting compensation and/or DHP for the lost entitlement.  Struggling to find regs and guidance on what LAs should be doing when they receive HB claim in UC full service areas - is anyone able to point me the right direction?

I don’t know about any specific guidance, but full service or not, they would still be under a duty to decide the claim if a claim was made. So if they did not do so in reasonable time you can complain on that basis, as it would be reasonable to expect that the LA would signpost the person to UC when informing them that they are not eligible for HB.  If your client has incurred financial loss them maybe a complaint to the Ombudsman.
