Just to let everyone know we had a recent success at a First Tier Tribunal in the case of an EEA national who was picked up,  detained, and deported by the Immigration Authorities.  He had been working at the point at which he was detained and at this point his HB was stopped as the Local Authority decided he no longer had a status as a worker.  Our appeal was on the basis of reasonable gaps between status as a worker and claiming - which meant HB paid for a five month period - I feel we were lucky from the legal point of view as he was never in the position to return to his work in the UK, so the gap didn’t have an endpoint at which he regained status, but the decision did reflect natural justice.
