Explicit consent in UC - Public Law Project request

Hi,

Alison Pickup of the Public Law Project is asking for help with the following -

“The Public Law Project has been approached by a number of welfare rights advisers about the problems caused by the DWP’s policy of requiring “explicit consent” in Universal Credit claims.

We think that there may be grounds to bring a judicial review of the policy as being in breach of the duty to make reasonable adjustments, in breach of the subject access obligations under the Data Protection Act and possibly on other public law grounds, and are investigating this further.

We are interested in hearing from organisations which have been particularly affected by this policy about how it has affected your service users, operations and other professionals.
