Good Morning and a belated happy new year to one and all.

I feel I already know the answer to the question however here goes.

I have a client who is partially sighted and was in receipt for many years of ESA and in the support group.
towards the end of 2017 he was encouraged to claim UC and told? verbally/online/that he will not be any worse off by transferring to UC.

Now he has received payment he is over £40 worse off per week, he has lost both his transitional protection and seems to have been placed in the wrag and not support group.

He is very angry and frustrated. I am due to see him this morning.

I believe once you are on UC you cant go back. He is on income based benefit he tells me.
I cant think of anything apart from being reassessed for the support group.

Any ideas very welcome

thank you for your help and assistance

best wishes

Nigel

HI

Do you know if his previous WCA was due for review? did he have a new WCA for UC? as far as I know if anyone transfers to UC and they have already had a WCA for ESA which is current, they do not need a new WCA and they should receive the appropriate LCW/LCWRA element in UC from the start of the claim without the need for reassessment (see TP reg 19) This should be the same as when on ESA.

Thank you

that’s what I thought.

I was trying to get ahead of the game but the client has not turned up as yet but at east we are thinking the same.
will see if they turn up.

Because they have lost over £40 per week on doing a QBC it seems to concur the same because you lose the transitional protection?

This person was invited to migrate over and as before implied would not be worse off but clearly they are at present.

thank you for your help

best wishes
