Think it’s this bit of HB reg 13(5)(b)
(5) Paragraph (4) shall not apply in the case of a claimant–
(a) to whom paragraph 4 of Schedule 3 to the Consequential
Provisions Regulations (saving provision) applies;
(b) to whom paragraph 14 of Schedule 3 (severe disability
premium) applies; or

4.1860 A young individual who is severely disabled is exempt from the SRR provided
they receive the higher or middle rate of the care component of Disability Living Allowance (DLA), and they do not have any non-dependants aged 18 or over living with them, (unless the non-dependant is also receiving AA or the higher or middle rate of the care component of DLA, or is blind), and nobody receives Carer’s Allowance (CA) for caring for them Note: This exemption does not require the award of a severe disability premium (SDP) in the claimant’s HB applicable amount – they need only fulfil the requirements of the above paragraph. 4.1861 Currently IS notices to authorities do not indicate if a claimant’s IS applicable amount includes an SDP. There are no plans to change this. However, because the requirements of paragraph 13 of Schedule 2 are tightly defined it is unlikely that there are many severely disabled young individuals who are not already exempt from the SRR, such as they are in accommodation provided by an RSL. 4.1862 However, be aware that the exemption exists and make all reasonable efforts to identify those affected, including using the Customer Information System (CIS), and asking claimants and the relevant DWP or Jobcentre Plus office(s).
