JSA/UC for carer when the person they care for is Sectioned under the MHA

Hello,

I have a client who is Sectioned (section 3 with no discharge in sight at the moment). She has been in hospital for 7 weeks so PIP DL has stopped and therefore her carer’s CA has stopped too. The carer was not getting IS or any other income.

The carer has no health conditions that are likely to qualify him for out of work benefits.

How do Job Centre tend to deal with cases such as these? Obviously this client could be in hospital for an indeterminate amount of time. Could be 7 more days, 7 more weeks or 7 more months.

I presume the carer just needs to get on UC/JSA as normal? I am not sure which Job Centre they come under so could be JSA or UC. What are the chances of getting some kind of special considerations for this in their claimant commitment/JSA agreement?

I imagine it may get tricky when she is discharged and he then has to stop work with a 4 week notice period etc. Can see this delaying her discharge potentially when she is medically well enough to leave hospital.
