Hello,

Can I check that this client should be claiming UC, not legacy? We are in full service area, and have been for a while.

He was claiming UC as a single person while working 24 hours. His family (wife + 5 kids) came over in early August as part of a family reunion visa. He informed UC, who closed his claim due to ‘lack of information provided’, when he queried this, he was told this was just a generic line as he simply wasn’t entitled due to the number of his children. He had provided sufficient information. Claim was closed back to the end of the previous AP (21st July).

He was told to claim JSA (did so, refused) and HB (did so, refused in detail due to previous UC entitlement).

We will be submitting a late MR and escalating but would welcome people’s opinions on whether we’re missing anything.

Surely closing the claim is just not lawful. It’s a change of circumstances on an existing UC claim, not a new claim (which would trigger refusal of UC and the claimant being directed to the legacy system)

As it is a change in the UC claim, surely the 2-child limit would apply if there are children born after 6/4/17, but the UC should not stop???

As for the ‘generic’ reason for closing the claim!!!! What a disgrace.

What do others think??
