Hi all,

I have a Colombian client with a complex residence rights case. It looks like he has acquired permanent residence and his immigration adviser has applied for a Home Office card.

The Home Office has all his ID(passport and residence permit) so I’m thinking that although he should be entitled, he won’t be able to claim if he can’t prove his identity?

Is there any way the JCP will accept a claim without proof of identity, or is he just going to have to wait until he has his docs back from the Home Office?

what is his current immigration status? He has an application in with the Home Office which means he is not here illegally.

What is his current status ie before the application.

He had an expired residence card as a family member of an EEA national.  We’d argue he has a permanent right to reside following 5 years as a FM of an EEA worker (or poss as FM of someone with permanent residence).  The issue is proving his identity, rather than his status.  Does anyone have any tips or experience of DWP taking claims from someone without any original ID? He’s worked before but has never claimed benefits.  Thanks in advance

He should have received a Certificate of Application letter when his application was received. Assuming that the status is not in doubt, then according to this guidance:

The applicant may not have their passport and state that it has been sent to the Home Office. In this instance they must provide their acknowledgement letter from the Home Office and a copy of their
passport. You will need to photocopy all of these documents.

NB, DWP say that they don’t “insist on the requirement to produce identity documentation, as we have alternative solutions for verifying customers’ identity”.
