Failure to attend medical - new claim not paid pending medical - medical cancelled
DMG 42204 also appears to agree that ESA should be paid under these circumstances
Maybe I’m doubtful as it seems too generous?

I’ve just been told my client has failed WCA so we will be lobbing in an appeal. I’ll let you know if they pay…..
John - to add to your sense of ignominy - not only have they agreed to pay him now he has appealed the adverse WCA decision but they have also paid ‘arrears’ him for the period leading up to the date that the WCA was undertaken.

Did they pay arrears to the point of the new claim (the new period of sickness?)
If so that was my original understanding and advice before I went off on my own somewhere advice-wise when things went awry.
At least I didn’t do it on a national forum in front of my peers…................ :-)

Yes, they have paid from the date he made the ‘new claim’ (after his previous claim was ended once he had failed to attend the previous WCA).
