Use of ESA50 to stop DLA
Has anyone had the experience where claimants completing an ESA50 because they are moving from Incapacity Benefit to ESA have had their ESA claim ended without a medical and have also received a letter ending their DLA? We have had two cases of this in teh last week. Ruth
With a medical yes - but without a medical seems very odd. Were they asked to attend a medical and failed to turn up?
I have had DLA claims refused and they have used an ESA50 as evidence, but ive never had ESA refused without a WCA.
Thanks for the replies. I have not seen the letters these clients received as they both contacted us by phone. - in both cases it is just possible that they did not read or understand a letter about an appointment for a medical, but not that likely. Anyway i will now wait until I have seen something in writing. Ruth
