Housing Benefit following permanent move to a care home
Exactly - I would expect there to have been a DOLs if she didn’t have capacity to consent to becoming a permanent resident.
Rosie, where can I find more about the DOL process?
My client’s father has been placed in care home and the Local Authority has been made aware in January 2022 that he has lost capacity to make decisions. HB stopped. No one has LPA.
His son (my client) has been residing in the property- but not a joint tenant, just excluded occupier. Yet the Local Authority required him to pay the rent and rent arrears. What should have been done re: father and his council tenancy and in what time frame (if there is any)?
