It has become a nightmare for so many with severe MH conditions because community support- already virtually non substantive/existent even when a community team involved pre pandemic- has all but disappeared.
Those who cannot manage remote support will be deemed to have disengaged and be discharged with the expectation of revolving door sections and when discharged in this way fall between GP and MH trust - bounced around until something possibly preventable happens.

Think some of the strength of argument is that 4 mnths is only the length of the hospital admission - there will have been a run up to this and post admission support needed= > 6 mnths.
Making sure the DM understands the Tribunal aware DM has been asked to reconsider case may tip balance when asking DWP reconsider and withdraw..

MH trusts do not give up their records easily and can rely on an exemption in data protection if asked to - they can take a request a a SAR whether stated as one or not and do so if worried about what certain reports say and want to redact,

But have had cases where for eg judge has ordered MH trust to provide the ‘sectioning’ application ( requires a magistrates warrant in non CTO community cases) which was then tied in with legal stuff via one of the above charities and a detailed claim form to back up.
