Hi All,

I am working with a Special Guardian.  Normally special guardianship allowance is not taken in to consideration as income for benefit purposes. 

I am trying to locate the Reg’s which confirms this for Universal Credit – I have searched but cannot find any information at all – Anyone have any idea where I might find this information or can anyone tell me if the Reg’s are different under UC?

Try regulation 66 of the UC regs - what counts as unearned income? My understanding would be if it’s not specifically listed, it isn’t counted.

Hi,

Thanks for your reply, I have looked and it is not mentioned there. 

Surely it can’t be taken into consideration as income, it’s a payment for the child and to prevent the child going into foster care.  I think they must have left it out!!!??

Reg 66 is a list of what does count as income: no mention in Reg 66 means it’s not income
