I’ve just had a two separate listings notices from FTT for the same date and time - one is DLA, the other IB. I called the FTT and asked how the panel would be set up given that there is no lay member in an IB appeal, and pointed out that the tests for both benefits are completely different. I stressed that I’m not happy with the appeals being heard together because of the completely different nature of the appeals. Am I being unreasonable? I was told that the FTT is simply ‘killing two birds with one stone’...

Can anyone point me in the direction of some caselaw on why they shouldn’t be heard together? Or something in Tribunal procedure which supports my argument? Or, indeed, tell me if I’m wrong to kick up a fuss about this?
