Ive just had a refusal with no face to face assessment. Mental health issues. If I request an MR will it prompt an assessment for further information or should I specifically request this?

I saw one of these recently; the form said “no problems” to everything bar one descriptor. Not too suprising they binned it without further ado.

Just going back to the mobility issue discussed further back; I discussed this with my favourite Judge and a PO last week; apparently they offered exactly the same guidance; i.e. people with MHPs not needing “guidance or supervision” when they introduced DLA. Now I was a pup when that happened but it’s ironic (at the very least) that they’ve made the same mistake again.

Is it lawful to have a PIP decision made without DM (or the HP) having had sight of the claimant’s PIP2 form?
