I have a very similar situation but not involving an appeal in the first instance. Client was awarded ERM/ERDL on first award of PIP and then only SRDL on second award. Client didn’t want to challenge the Daily Living component but recon/appealed her nil mobility.
Appeal bundle received and no documents at all relevant to previous award of ERDL/ERM.
I requested directions for documents from the first PIP claim to be produced. Judge issued directions on 7/8 for all documents to be produced within 14 days (appeal by then listed for 7/9) and if not received in the timescale case to be referred back to the judge urgently. No response at all from DWP and case not referred back as requested. I return from annual leave and have to chase the case and requested that the district judge looked at it on the Friday before the appeal hearing on the Monday (I didn’t want her to travel an hour to find the appeal was adjourned for the documents). The DJ ruled that the appeal could go ahead without the documents. Computers down on the day so still awaiting the result but I still feel that all documents should have been available as this was a renewal UNLESS each claim is considered to be a new claim and all previous claims are deemed irrelevant.
