I have a client that requested her forms in Dec 09 but did not return this until feb 10. She is suffering from mental break down and was unable to get the forms in sooner because of this and had to wait on an appointment with our office CPAG p155
makes it clear that this has to be with the office one month after forms are requested and I see no expections for this. The client wants to go ahead with the appeal but can find nothing of help to win the appeal. Can I use good cause rules for this or has anyone else come across something similar but handled it in a different way

If your client was paid from Feb 2010 the simplest thing to do is just to ask for the full 3 months backdating on the current claim - no good cause is needed for this, just a backdated sick note for the period (some GP’s dont like doing these, though) - this will take you back to December and is alot easier.
