Hello as I understand it following the death of a none-dependent in the household the housing element should continue for the next two assessment periods. UC have paid the housing cost for the Assessment Period in which she died but not the following two.  Her son was receiving the Carers Element in his UC for looking after her - however just before her death he himself went through the WCA and was placed in the LWCRA. Could that be why he has not received this run-on in housing costs?  Should we ask for an MR of the failure to run-on Housing Costs?

Definitely, yes.  Protection after death doesn’t erode like transitional protection: the wording in the regulation is “the award is to continue to be calculated as if the person had not died for the assessment period in which the death occurs and the following two assessment periods”.

The LCWRA element will “trump” the Carer Element during the run-on, but the housing element should continue to be calculated as if the non-dep were still alive for two further APs.
