when were HB aeards excluded as incpome from UC benfit cap figures?

Got a DHP request for customer is temp accomm since 2014 (!!!)
She was on ESA IR , that ended Feb 2019 and she hasnt claimed anything since - just tax credits and Cben. (lone parent, 4 kids so CTC is approx £300 a week and rent on temp accomm £360 a week , hence the cap
Shes been capped pretty much continuusly since 2014

I know that HB doesn’t count towards income when UC are calculating benefit cap - but does anyone remember whether that has always been the case, or if not, when it started?

Cant see we nor her housing officer have ever explained that ben cap wont apply while in temp accommodation if shes on UC - she cant move to perm accomm as her arrears are preventing an offer.

Even prior to that date, HB wouldn’t have counted towards the benefit cap.

It was just that until that date the benefits which counted towards the benefit cap were explicitly listed in the UC Regs, and didn’t include HB.
From 2016, the primary legislation was amended to include a list of the benefits which counted towards the benefit cap, and HB was included there. It was therefore necessary to amend the UC Regs to specifically exclude HB.

So, the answer to the OPs question, in short, is that HB never counted towards the benefit cap in UC.
