Hi there I was wondering if someone would be able to advise?
I have a client who was on UC, turned pension age on 10/01/24
UC assessment phase is 7th of month to 6th of month

Client switched from UC and State pension.

He received £495.06 for period 10/01/24 to 26/01/24

for the UC period 07/01/24 - 06/02/24 , £813.17 was deducted, even though he only received £495.06 in state pension

I am unsure how they have calculated this, would anyone be able to provide info regarding the rules and regulations around this.

I think for the assessment period they will also include as income for UC the state pension amount that will be paid from 27/1/24 - 6/2/24 even though he hasn’t actually received this yet.  Would that make the figures add up?

Agree with Mairi, it will be the pro-rata state pension for that assessment period - ie under reg 73(2A)

If he gets the full new state pension of 203.85 per week that would be:

28 x (883.35 x 12)/365 = 813.17

Whether they’ve got it right depends what his weekly entitlement to state pension actually is, but the amount he
received in January & the period involved suggests it is £203.85 a week.

Thank you - yes £815.40 every 4 weeks so £203.85 per week. Thank you for providing the legislation
