Can any one quote a recent decision that stated if medical notes from a previous WCA/PCA exists then they should be in the appeal papers not just the list of the awarded descriptors from the previous medical.

It seems to be policy from local BDC that they do not send these because
‘Health and safety reasons they cannot be retrived.’ (!!!!!)

Another client states he apparently attended 3 medicals.
The first he was told be the doctor he passed. They lost the medical notes and or deny it went ahead.
The second he again attended. They deny this went ahead or was even booked.
The third he attended and was failed by the same doctor as the first despite stating to him ‘I’ve Seen you before.’ reply ‘No you haven’t.’ reply ‘Oh yes I have.’
The BDC are in denial about these to any request for copies but the time delays in IB50, medical, and then decision support the client as it cover an inordinate period

The case has been adjourned pending an order by the Jufge to medical services to provide evidence.
