I have a married couple who DWP have finally accepted after 6 months of arguing are no longer a couple. The relationship is as carers for each other. She has ESA (support) which we successfully had EDP added to. (still need to argue backdating as only backdated 3 months) She also has DLA high care.

He has ESA (WRAG) with a carers premium and CA deducted (cares for her) He has just been awarded PIP standard care.

I intended asking him to relinquish the CA so both could have SDP added to individual ESA awards. However not sure if each will be treated as a non dep. They have separate living areas but share a kitchen. however as both have qualifying benefits does SDP apply ?

If they have qualifying benefits they are not counted as a non-dep for purposes of SDP

Does she get cbESA or is it all ibESA?  If she gets cbESA she can claim CA and get the C Prem as well as both of them getting SDP.
