Hiya,

Has anyone had any luck getting compensation from the DWP for delays in a WCA that has resulted in a claimant not getting WRA (or support) component of IR ESA?

I have two cases:

1 - client claimed ESA in March 2014 as a result of an accident. Assessed Dec 2015 found fit for work. He has recovered from injuries so does now considers he is fit for work.

2 - client applied fro ESA in May 2015., he has still not received an WCA and next week will be entitled to his state pension so no longer eligible for IR ESA.

Any thoughts other than a strongly worded complaint?

I argued this point before in the post below…

Employment & Support Allowance - Payment of Work Related Activity Component

Unfortunately they changed the PIP Regs before I got to the UT to argue this point on 2 occasions ie payment of the WRAC from week 13 in any event.
