Students and Non deps

Hi

Tenants lives on her own in a 3 bed. 2 sons are both away at Uni. HB are not applying the bedroom tax for either sons but are treating them as Non Deps during the summer holidays. Neither are working or claiming any benefits. Is that right? I though there was no NDD unless they were working and earning.

A quick glance at the DRH p187 reads that there is no NDD where the non-dep:

“[is] a full time student (...there is a deduction in the summer vacation if they taske up remunerative work unless they are 65 or over)”

It cites HB regs 74(1), (6)-(8) and (10).

Sorry, I don’t have time to check it, but it looks like you’re right, unless they are part-time students.
