Community Work Placement DWP internal guidance
Can anyone provide a copy/link to the DWP internal guidance on selection & referral to the CWP scheme under the JSA(SAPOE)Regs? I know the provider guidance is in Resourses and a FOI request in March 14 for the DWP guidance was refused at the time.
Senario is a lone parent with child aged 10 being mandated to start attending on the 1st day of the school holiday!

Unfortunately not. What I am looking for is any internal JCP guidance for PI’s/Work Coaches on selection and referral to providers for CWP’s. I am assuming there is such guidance similar to the internal guidance for the Mandatory Work Activity scheme that has been disclosed following a FOI.
Its interesting that DWP publishes the provider guidance but not the internal guidance for these schemes!?
There is this FoI obtained guidance about the Help To Work scheme which incorporates referrals to CWP, might be helpful Peter?
Could really do with someone taking the time to collate this material as it’s all over the shop.

See para.81 Step 2 which states that the CWP referral should take account of any restrictions on the claimant’s availability agreed in the CC.
I’d be making an argument that this claimant should clearly be able to restrict her availability under regs 13 (caring responsibilities) and 13A (lone parent restrictions) and that this would have a direct impact on her ability to meet the requirements of being referred to the CWP placement, let alone also being required to keep to her usual signing demands as well.

This is what we were looking for. Will use it to back up representations made and a request to vary her Commitment. It now transpires JCP were going to require her to attend daily signing but ‘came up’ with CWP as the alternative when she made representations about childcare. Experience suggest she will still end up being sanctioned! Looks like a classic case of JCP ingnoring any guidance, acting unreasonably and setting client up to fail.
Interestingly have a case before UtT on the MWAS where JCP ignored its own guidance and mandated client to attend when the guidance clearly stated he should not be selected (he was already undertaking very similar voluntary work - in a different charity shop).
Also informed that the CWP provider visited her at home yesterday evening and stated she must find childcare by Monday (Residence Order restricts who client can leave the child with).
Oh that’s ridiculous. There must be a safeguarding issue challenge in there somewhere surely? Honestly- it reslly does beggar belief sometimes.
