Was it a dream? Caselaw hunting…
Recently I’m sure I read a UT decision discussing the old mechanism for Work Focussed Health Related Assessments and the new mechanism in the ESA (WRA) regulations.
I can’t remember the context of the decision and I’m hoping someone can point me in the right decision.
I’m thinking it was a Jacobs decision but I might be wrong.
Ta.
Think this may be the one by Judge Gray - Case No. CE/973/2013
MT v Sec of State for Work and Pensions (ESA) [2013 UKUT 0545 (AAC)
See paragraph 20 onwards.
I understand the Sec of State has applied for permission to appeal to the Court of appeal on this decision.
Hope it helps
