PIP to DLA, no entitlement, MR decision postive.

My question is whether in this scenario, when the DLA mobility transmutes to PIP DL and Mobility on MR. Does the award run from when the MR decision is made or should it run from date of refusal? Simply because my client has lost 3 months DLA HRM because the initial PIP decision nilled her claim. Thanks Terry

Terry, as I understand your question this happened:

C in receipt of DLA HRM
Claimed PIP
Decision made that no entitlement to PIP Mobility
Requested MR of that decision
PIP ERM awarded as result of MR

Is that correct?

If so, as I understand it, PIP ERM award should commence 4 weeks after the decision is made to award it. DLA HRM should be paid up to the day before that.

In practice, as DLA HRM and PIP ERM are paid at the same rate, it does not matter if the PIP ERM is backdated or the DLA HRM award is reinstated for the period between the initial disallowance and the revision on MR. But either DLA or PIP has to cover that 3 months period you refer to, there is no black hole, the claimant has continuous entitlement.
