Client refuses to sign fitnote
Hello,
We are supporting a client with severe and enduring mental health problems to make a new claim for esa. They are refusing to sign the fitnote. This is a start of a new claim with request for backdating as previous claim lapsed due to client not informing staff re dwp letters.
Does anyone know if there is anyway dwp would be able to accept the fitnote unsigned?

They should but they won’t.
Interestingly it is only the doctor’s statement part of the med 3 that is prescribed by the medical evidence regs; the claimant statement is not part of the prescribed form.
I’d sent it in with a cover letter and also explain that even if the claimant signature were a prescribed requirement the Sec State has a discretion under reg 2 1A of the medical evidence regs to accept such other information as might be appropriate in the circumstances.

If it were me; and knowing we work in similar roles; I’d probably shove as much contemporary medical evidence at them as possible. If he’s as unwell as he sounds it might move a sympathetic DM.

Thanks again Dan. Psychiatrist will happily do said letter and there is sadly plenty of comtemporary supporting evidence to send.

Oooops! My dream of having a radio on whilst working led me to a more positive assumption!
