Pension Credit Overpayment from 2003

Hi All,

I have a Cl who the DWP are seeking to recover an overpayment of £30k on the basis that the she ‘Misrepresented of the material fact that she was in receipt of an occupational pension’

Cl doesn’t remember making a claim for PC, she said that she was simply transferred over.  So I am assuming she was previously receiving MIG. I am about to assist Cl with an appeal. 

Does anyone have any tips for appealing the decision?

Cl is 89 and the DWP scared her half to death, what with them visiting her at her home and interviewing her.

It states within the decision that the Cl did not declare her OP on an Income Support review form dated March 1999.  But they are stating Cl has been OP’d within her PC claim from 2003 to 2015?

I have just replied to the OP thread on here but not sure if my post has been seen.

Any further information would be a great help.

See the other thread on PC overpayments which is currently live again. Everything there holds true I think.
